Will IP Lawyers Explode 'Supernova'?

We all have our summertime guilty pleasures, and mine is the TV rock-reality competition Rock Star: Supernova, in which 15 tattooed and talented hopefuls compete to front the new band Supernova. But now I fear IP lawyers will deprive me of my fun.

The problem, as reported by Andrew Raff at IPTAblog, is that there already was a band named Supernova, formed in 1989 and releasing a major-label album in 1995. Where to turn but federal court? Supernova -- the first one -- has filed a federal court lawsuit against Supernova -- the second one -- along with producer Mark Burnett, CBS Broadcasting and others. As Raff recounts, the old -- I mean, former -- Supernova alleges trademark infringement, false designation of origin and intentional interference with prospective economic advantage.

As legal professionals, do we side with the IP lawyers or the aspiring rock stars? One lawyer, Kevin Heller, knows where he stands. He's rooting for Storm Large. As for me, I'm heading out for a tattoo.
