Tiny Speck in Universe Suing Dido for Using His Photo on Album Cover

Do you see the plaintiff in the image above? No, not that fleck of dust on your screen. Look above the earth, but below the text. Under the "H" in the word "Home." See that? That little speck of white is Bruce McCandless, a NASA astronaut who is suing singer Dido, Sony Music, Arista Records and Getty Images for using his picture. THR, Esq. reports that McCandless alleges that the defendants took his "persona" for commercial use on Dido's hit album, "Safe Trip Home."

The photo of McCandless was taken in 1984 by a fellow astronaut, and was named by Life.com as one of the "21 Greatest-Ever Space photos." According to THR, Esq., Sony acquired the rights to the image for use on Dido's album but "allegedly didn't clear the right to use the persona of McCandless." McCandless claims that this misappropriation deprived him of endorsement value.

In other news, all of the "Whos down in Who-ville" are now seeking legal counsel.
