10TH CIRCUIT MATH: HARASSMENT + SEX HARASSMENT = BIG TROUBLE
Mike Fox writes about a classic question faced by the 10th U.S. Circuit Court of Appeals in a case brought by two female employees of a New Mexico Boys' School:
"[Can] plaintiffs use a substantial amount of arguably gender-neutral harassment to bolster a smaller amount of gender-based conduct in opposing summary judgment?"
